Subject: curious about posters in Pizzicato restaurants
Hi!
Are any of the posters displayed in your restaurants available for sale? I enjoy the style of the artwork used on these posters, and particularly admire the “Office Romance” poster. If not available for sale, do you have any emailable pictures of this “Office Romance” picture you might be able to send along? I didn’t see it on your website…
Your fervent customer,
J. Pinkham

Dear J. Pinkham,
Thank you for your interest in Pizzicato posters and art. It's always nice to hear that our customers enjoy their surroundings while dining at our restaurants! Unfortunately, we are unable to sell or email you any images. They are copyrighted to us and we are not allowed to distribute them in any way.
Thanks again for your loyal patronage to Pizzicato. If you have any further questions, please don't hesitate to email back.
Sincerely,
K.

So where'd you get the image, then?
Posted by: PinkDreamPoppies at April 3, 2004 11:15 AMJust by holding down your mouse button when the cursor is over the image. In Explorer, at least, a drop menu should appear providing the option of opening the image in a new window, from which you can copy the URL and enter it into the tag.
As Kip notes at his blog, this letter shows a strange understanding of copyright law. If you own the copyright to something, you can distribute it any way you want. Er, right?
Posted by: Kevin Moore at April 3, 2004 01:43 PMThe image I used on the blog entry is in the same graphic style as the poster I was specifically requesting, but isn't the same one. The one I was after was a dark blueish one that shows a pale-skinned gal with a Louise Brooks haircut holding a slice of pizza.
The main purpose of this entry was to expose to ridicule some of the absurd time-wasting activities I can get into, but I'm glad the copyright aspect of the post generated some interest. This person who wrote me back apparently hasn't heard of selling branded promotional items to generate consumer interest. Kind of like writing to Nike and asking if they have any t-shirts with the swoosh logo on 'em for sale and being told "we can't sell anything like that to you, my nasty mans, because we own the copyright on the swoosh and you don't!"

Note that they actually said "they are copyrighted to us" -- I get the impression that they only have legal right to use the images in a limited context not give it away. I'm not a copyright lawyer, but this makes sense to me, and I bet it happens all the time. It does seem like the author of that letter might need an upgrade on their writing skillz, though.
Of course, they could just be bastards, too.
Posted by: Glenn Peters at April 3, 2004 09:06 PMWhat the phrase "they are copyrighted to us" means is that they have a limited license; that is, they have permission to use the images but not resell or distribute them. It's an odd phrase to be sure, but I've seen it twice before when I've tried to license commercial art for secondary publication.
Posted by: Lisa at April 3, 2004 11:09 PMIt's extraordinarily clumsy verbiage on a subject that desperately needs clarity in this day and age. I'm even more taken aback to learn it isn't just limited to Pizzicato. Oy.
PS: Pinky's use above is pretty squarely within the bounds of Fair Usage, as I understand it. In case anyone was worried.
Posted by: Kip Manley at April 4, 2004 01:15 AMWhy is that woman with the classic Judy Gold curl eating what looks like a giant saltine with Terra chips stuck to it if she's supposed to be in a pizza parlor ?
This has been a bad week for me, comprehension wise. :o
